GENERAL TERMS & CONDITIONS FOR 8 BY SKILLMILL ONLINE SHOP

1. General
All offers and services provided by the 8 by Skillmill online shop for the customer, as well as the use of the website, are based exclusively on the following general terms and conditions. Changes, supplements and ancillary agreements to these terms and conditions must be made in writing to be effective. General terms and conditions of the customer that deviate from our general terms and conditions do not become part of the contract.

 

2. Conclusion of contract in the online shop
The offers of the online shop on the Internet represent a non-binding invitation to the customer to order goods.

By ordering the desired goods on the Internet, the customer submits a binding offer to conclude a purchase contract.

The 8 by Skillmill online shop is entitled to accept this offer by sending an order confirmation. Acceptance occurs when Skillmill confirms the order by email. 

 

3. Delivery times
Delivery is made by sending the goods to the address provided by the customer against the specified packaging and shipping costs. If the customer wishes a special type of shipment that involves additional costs, he must bear these.
Delivery takes place both within the European Union and globally.

The delivery times within the EU are usually in between 5 and 15 working days and begins on the day after the order is placed.

In the event of delays in delivery, such as force majeure or traffic disruptions or other events for which the online shop is not responsible, no claims for damages can be made against us.

 

4. Packaging and shipping costs
For orders, we deliver according to the shipping costs specified in the online shop.

 

5. Payment, late payment and retention of title
Payment for delivery is possible by

PAYPAL/CREDIT CARD
The customer is obliged to pay the purchase price during the ordering process.

PAYMENT IN ADVANCE
If you pay in advance, you will receive an e-mail from us with the exact invoice data. Therefore, please be sure to enter your e-mail address and/or telephone number in the order form so that we can contact you. When making your transfer, please state your name and invoice number as reference so that we can allocate your incoming payment to the order.

The delivered goods remain the property of the 8 by Skillmill online shop until full payment has been made (retention of title). Disposal, in particular pledging, assignment as security, processing or transformation, is not permitted prior to the transfer of ownership without the express consent of the online shop. If third parties access the reserved goods, the customer is obliged to inform Skillmill immediately and to inform the third party of the retention of title. If the customer intends to resell goods to third parties, he is obliged to pass on Skillmill's retention of title. If the agreed payment deadlines are exceeded, we have to charge reminder and processing fees.

 

6. Prices
The prices of the specified goods are final prices, which include VAT at the rate of 20%. They do not include packaging and shipping costs (see No.5).

 

7. Right of withdrawal
Skillmill is entitled to withdraw from the contract if important reasons exist. Important reason is in particular the non-payment or only partial payment by the customer despite a written reminder.

In the event of withdrawal, Skillmill has the choice of requesting compensation for damages of 15% of the gross invoice amount or compensation for the actual damage in addition to reclaiming the purchase price.

If, after conclusion of the contract, Skillmill determines that the ordered goods are no longer available or cannot be delivered for legal reasons, Skillmill reserves the right to withdraw from the contract. Payments already received will be refunded by Skillmill immediately after withdrawal from the contract. 

In the event that Skillmill has made a printing error in the product information, Skillmill is entitled to withdraw from the contract immediately, in which case claims for damages against Skillmill are excluded. 

 

8. Refund policy
Unused items can be returned by a consumer within the meaning of the Consumer Protection Act in their undamaged original packaging within 14 working days of delivery. Saturday does not count as a working day. The consumer bears the shipping costs for the return and has to pay Skillmill a reasonable fee for the use including compensation for the depreciation.

The consumer is asked to contact us before returning the goods and to use our address given below for his shipments. Reduced items are excluded from return. 

 

9. Right of withdrawal and consequences of withdrawal
The instructions on your right of cancellation and the consequences of cancellation are attached as an appendix and are part of the present General Terms and Conditions.

 

10. Transport damage
The customer checks the goods upon receipt. If transport damage to the goods is found, the recipient/customer must immediately report the damage to the carrier (shipping service). If the partial loss or damage is not externally visible, the customer must report this to Skillmill within five days of delivery or to the transport company within seven days of delivery in order to ensure that any claims against the transport company can be asserted in good time . The customer will support Skillmill to the best of his ability insofar as claims against the relevant transport company or be asserted against the transport insurance.

The customer's claims, in particular due to defects in the item, remain unaffected.

 

11. Warranty
11.1 In the event of defects in the delivered item, the customer initially only has a claim to improvement.

11.2 Consumers have the choice of whether to request improvement or replacement. However, Skillmill is entitled to refuse the type of improvement chosen if it is only possible with disproportionate costs and the other type of improvement remains without significant disadvantages for the consumer.

11.3 Skillmill initially provides the entrepreneurs with a guarantee for defects in the goods by improving or supplementing the missing items at their own discretion.

11.4 The customer is not entitled to rectify an existing defect himself or have it rectified by a third party without the consent of Skillmill. If he has incurred expenses for this, the customer is not entitled to any compensation.

11.5 If the improvement fails, the customer can request a price reduction in accordance with the statutory provisions, and in the case of defects that are not minor, can cancel the contract (rescission).

11.6 In the case of new items, the warranty period for the rights of a consumer in the event of defects is two years, for the rights of an entrepreneur one year from delivery of the goods. Any manufacturer guarantees listed in the offer are exclusively binding on the manufacturer. Skillmill's own assumption of a guarantee is hereby excluded.

11.7 There is no warranty for damage caused by improper use or handling of the item or by willful damage.

11.8 Entrepreneurs must examine the goods for defects and immediately report obvious defects in writing; otherwise the assertion of the warranty claim is excluded. The timely dispatch of the defect notification to Skillmill is sufficient to meet the deadline.

 

12. Privacy
The data you transmit will only be used by us to process your orders. All your data will be treated in strict confidence. We only pass on the data to third parties (e.g. shipping services) if this is necessary for order processing. However, we assume no liability for data security during transmission over the Internet (e.g. due to technical errors on the part of the provider) or for possible criminal access by third parties to files on our website. Access data for the customer login, which are sent to the customer at the customer's request, must be treated as strictly confidential by the customer, as we assume no responsibility for the use and application of this data. Any further disclosure of your personal data will only take place with your express consent.

All photos, logos, texts, reports, scripts and programming routines presented on these pages, which are our own developments or have been prepared by us, may not be copied or used in any other way without our consent. All rights reserved.

 

14. Validity of the terms and conditions
With an order, the general terms and conditions of Skillmill are accepted. Should a provision of these General Terms and Conditions be void for whatever reason, the validity of the remaining provisions shall remain unaffected. Verbal agreements require written confirmation. The place of performance and place of jurisdiction is Vienna, unless otherwise regulated by law. The substantive law of the Republic of Austria applies, excluding the reference standards and the UN sales law.


Appendix: cancellation policy

Right of withdrawal:
Consumers have a right of withdrawal with regard to purchased goods. You can revoke your contract declaration within 7 working days without giving reasons in text form (e.g. letter, fax, e-mail) or by returning the item. Saturday does not count as a working day. The period begins on the day the consumer receives the goods. It is sufficient if the declaration is sent to Skillmill within the deadline.

Consequences of revocation:
In the event of an effective revocation, the mutually received services are to be returned and, if necessary, drawn uses (e.g. B. Interest). If you are unable to return the service received to us in whole or in part, or only in a deteriorated condition, you may have to reimburse us in this respect. provide compensation. 

The deterioration caused by the intended use is not taken into account. In addition, the obligation to compensate for the value does not apply in the event that the consumer cannot return the received service in whole or in part or can only return it in a deteriorated condition, when items are provided if the deterioration of the item is solely based on their inspection - as is possible in a shop, for example would have been – is due.

In the case of a return from a delivery of goods, you have to bear the costs of the return if the delivered goods correspond to those ordered.

The right of withdrawal does not apply to contracts for the delivery of goods that are manufactured according to customer specifications or contracts for the delivery of newspapers, periodicals and magazines.
